Different states have different time limits. Just to give you an example; in Victoria, you have 6 months to file a claim because after 6 months the executor of a will can distribute the estate. However, you can file a claim after 6 months citing the reason for the delay to the court. 

If we talk about Queensland, you have 9 months after the death of the deceased to file your claim. However, it is important to know that you should give notice to the executor in writing to make a claim against the executor within 6 months.
